Welcome to ChukaCribs ("we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and services available at https://www.chukacribs.co.ke (collectively, the "Services"). By accessing or using ChukaCribs, you agree to these Terms. If you do not agree, do not use the Services.

1. Definitions

• Services: the website, subdomains, APIs, mobile apps, and related services provided by ChukaCribs.
• User: any person who accesses or uses the Services, including students, landlords, and visitors.
• Listing: a property listing created by a landlord or their agent.
• Booking: a reservation or purchase of a service or access via the platform.
• User Content: any content you submit to the Services (reviews, messages, listings, images).

2. Eligibility

You must be 18 years or older to use ChukaCribs. By using the Services you confirm you have legal capacity to enter into a binding agreement. You agree to provide accurate, complete, and up-to-date information and to update it if it changes. We may require identity verification for certain features; refusal may limit access.

3. Accounts

Certain features require registering an account. You agree to: keep your login credentials secure; notify us promptly of any unauthorized access; and be responsible for activity on your account. You must notify us within 48 hours of discovering unauthorized access. We may suspend or lock accounts for suspicious activity.

4. Use of the Platform

You must not: (a) violate laws or third-party rights, (b) attempt to hack, probe, or disrupt the Services, (c) scrape or copy data without permission, (d) impersonate others, or (e) use the platform for fraudulent activities. We may suspend or terminate accounts for violations and may cooperate with law enforcement.

5. Listings, Bookings, and Payments

ChukaCribs is a platform connecting Users with landlords and property owners. We are not the owner of listed properties unless explicitly stated. Booking confirmations are subject to the terms shown at the time of booking. The booking is confirmed when the payment processor approves payment and we send a confirmation to your registered email. Refunds, cancellations, and disputes are governed by the policies displayed during booking. Payment processing is performed by our third-party payment provider(s). We do not store full payment card data; recurring payments use tokens. Users are responsible for chargebacks and fees where applicable.

6. User Content

You retain ownership of content you submit, but grant ChukaCribs a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, distribute, and promote that content in connection with the Services. You warrant your User Content is lawful, does not infringe third-party rights, and is not abusive, misleading, or harmful. We reserve the right to remove User Content that violates these Terms or our policies.

7. Privacy

Use of the Services is subject to our Privacy Policy, which explains collection, use, and sharing of personal data.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be posted in advance where practicable. We are not liable for temporary outages or performance degradation, including those caused by third-party providers.

9. Termination

We may suspend or terminate access for breaches, unlawful behavior, or misuse. Notice will be sent to your registered email when possible. Users may terminate their accounts at any time. Termination does not relieve you of outstanding obligations (e.g., unpaid fees, disputes). Data retention after termination follows our Privacy Policy and applicable law.

10. Intellectual Property

All site content, branding, code, and designs are owned by or licensed to ChukaCribs. Unauthorized copying or distribution is prohibited. If you believe your IP has been infringed, contact our designated agent at support@chukacribs.co.ke with a takedown request and necessary information.

11. Warranties and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. We do not warrant the accuracy of listings or the conduct of third parties. You use the Services at your own risk. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot lawfully be excluded.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHUKACRIBS'S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID TO CHUKACRIBS IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, OR LOSS OF DATA. Certain jurisdictions may not allow limits on liability; where prohibited, liability will be limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify and hold ChukaCribs harmless from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: your misuse of the Services; breach of these Terms; or your User Content. We will provide prompt notice of any claim and cooperate in defense; you may control defense of claims where permitted by law.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of Kenya. You and ChukaCribs agree to submit to the exclusive jurisdiction of the courts of Kenya. Before filing suit, parties agree to attempt good-faith mediation. (Add arbitration clause if desired.)

15. Changes to These Terms

We may update these Terms. For material changes, we will notify users by email and/or site notice at least 14 days before changes take effect where practicable. Continued use after changes constitutes acceptance.

16. Additional Provisions

• Severability: If a provision is invalid, the remainder remains in effect.
• Waiver: Failure to enforce any right is not a waiver.
• Assignment: We may assign these Terms in connection with a merger or sale; Users may not assign without consent.
• Entire Agreement: These Terms and Privacy Policy constitute the entire agreement between you and ChukaCribs concerning the Services.
